Terms & Conditions

These Terms & Conditions form the agreement between James Polley Photography (“the Photographer”) and the Clients (“the Couple”). By booking, the Couple agrees to the following terms.

A non-refundable booking fee is required to secure the wedding date. The remaining balance must be paid no later than 1 week before the wedding day, and dates cannot be held without the booking fee.

All booking fees are non-refundable under any circumstances. If the Couple cancels the booking after the final balance has been paid, no refunds will be issued. In the unlikely event that the Photographer must cancel due to unforeseen circumstances, a full refund of all monies paid will be given, and reasonable efforts will be made to assist the Couple in sourcing an alternative photographer.

The Photographer will capture the wedding day in their professional, documentary style. While every effort will be made to cover all important moments, specific images cannot be guaranteed. A curated selection of fully edited images will be delivered that best tells the story of the day. Not every image taken will be included in the final gallery, and under no circumstances will unedited RAW files be shared. The number of final images will vary depending on the package chosen and the flow of the wedding day.

All photographs are edited in the Photographer’s signature style. Any additional retouching or specific editing requests may incur an additional charge. The Couple acknowledges that weather and lighting conditions, such as rain or lack of sunshine, may influence the overall tone of the images, producing darker or moodier results.

A preview selection of photographs will be delivered within several days of the wedding, with the full online gallery provided as soon as possible, around 8 weeks. Albums, prints, and other products may take longer depending on production times.

All images remain the copyright of James Polley Photography. The Couple is granted a personal licence to download, print, and share the images for non-commercial use. The Photographer retains the right to use images for portfolio, marketing, and promotional purposes, including on websites, social media, and printed materials.

The Photographer will take all reasonable care with images and equipment. However, in the unlikely event of a technical failure, loss, or injury, the Photographer’s liability will be limited to the refund of monies paid. The Photographer is fully insured with public liability.

In cases of extreme circumstances beyond the Photographer’s control, such as illness, accident, fire, pandemic, severe weather, the Photographer will not be held liable for any failure to deliver the agreed services.

By paying the booking fee, the Couple confirms they have read, understood, and agreed to these Terms & Conditions.
